Westboro Baptist Church, a group known for protesting and picketing funerals and memorials of fallen soldiers, is planning to picket at the Sunday afternoon funeral of 18-year-old Auburn freshman Lauren Burk, according to the group’s Web site. Burk was killed Tuesday night. Police are investigating her death as a murder.

Westboro Baptist Church, established in 1955, is an Kansas-based organization lead by Pastor Fred Phelps.

The group is also planning to picket the funeral of Eve Carson, UNC student body president who was killed Wednesday morning.

Both funerals are listed on the WBC site’s online picket schedule for Sunday.

First the Phelpses came to picket the funerals of men murdered by gay-bashers.

Then they came to picket the funerals of AIDS patients.

Then they came to picket the funerals of soldiers killed in combat.

And now, having given up any pretense of having a particular target other than humanity and simple decency, they’re just showing up to any old random funeral, so long as they know that the news media will be in the area.

What they are doing now is no more, and no less, evil than what they did to Matthew Shepard’s family. I would say that the cruelty here is more bizarre, but it’s not, really, when you understand some basic facts about the Phelpses. They have shown repeatedly, by their words and their deeds, that they thrive on being hated and provoking reaction. There is literally nothing at all that is beneath them, as long as it gets their names and their websites in the news yet again. And it will.

You put your trust in the state because it filters out complexities of life you either cannot manage on your own or see no need to. Why do people obey unjust laws? Law and Orders: UCLA campus police “found it necessary” to repeatedly taser an Iranian student already lying helpless on the ground

Cops in America are heavily armed and trained to be bullies, and they routinely hurt people who are not posing any serious threat to anyone, in order to make sure that they stay in control of the situation. They have no trouble electrifying small children, alleged salad-bar thieves; or pregnant women possibly guilty of a minor traffic violation, if they get tired enough of being talked back to and if their bellowed orders are no longer sufficient to end an argument-even without any plausible reason whatsoever for fearing any physical threat to themselves or others. When they are caught in the act police administrators will wring their hands, make up some lies to try to excuse the assault, promise an investigation, find that Official Procedures were followed, and then do nothing at all, except perhaps question the decision to arm the pigs with tasers (as if the equipment were the issue here). This is a cellphone video of what happened to UCLA student Mostafa Tabatabainejad when he refused to show identification to campus police and then demanded that they not touch him while he left the library.

The latest in a recent spate of cellphone videos documenting questionable arrest tactics surfaced Wednesday, this one showing a UCLA police officer using a Taser to stun a student who allegedly refused to leave the campus library.

Grainy video of the Tuesday night incident at UCLA's Powell Library was broadcast Wednesday on TV news and the Internet, prompting a review of the officers' actions and outrage among students at the Westwood campus.

The footage showed the student, Mostafa Tabatabainejad, falling to the ground and crying out in pain as officers stunned him.

According to a campus police report, the incident began when community service officers, who serve as guards at the library, began their nightly routine of checking to make sure everyone using the library after 11 p.m. is a student or otherwise authorized to be there.

Campus officials said the long-standing policy was adopted to ensure students' safety.

When Tabatabainejad, 23, refused to provide his ID to the community service officer, the officer told him he would have to show it or leave the library, the report said.

After repeated requests, the officer left and returned with campus police, who asked Tabatabainejad to leave multiple times, according to a statement by the UCLA Police Department.

He continued to refuse, the statement said. As the officers attempted to escort him out, he went limp and continued to refuse to cooperate with officers or leave the building.

Witnesses disputed that account, saying that when campus police arrived, Tabatabainejad had begun to walk toward the door with his backpack. When an officer approached him and grabbed his arm, the witnesses said, Tabatabainejad told the officer to let go, yelling Get off me several times.

Tabatabainejad encouraged library patrons to join his resistance, police said. The officers deemed it necessary to use the Taser.

Officers stunned Tabatabainejad, causing him to fall to the floor.

The video shows Tabatabainejad yelling, Here's your Patriot Act, here's your … abuse of power, the Daily Bruin reported, adding he used a profanity.

It was beyond grotesque, said UCLA graduate David Remesnitsky of Los Angeles, who witnessed the incident. By the end they took him over the stairs, lifted him up and Tasered him on his rear end. It seemed like it was inappropriately placed. The Tasering was so unnecessary and they just kept doing it.

Campus police confirmed that Tabatabainejad was stunned multiple times.

By then, Remesnitsky said, a crowd of 50 or 60 had gathered and were shouting at the officers to stop and demanding their names and badge numbers.

Remesnitsky said officers told him to leave or he would be Tasered.

Tabatabainejad declined to comment. He was arrested Tuesday night and cited by campus police for resisting and obstructing a police officer and was released.

The incident was the third videotape of an arrest to surface in the last week in Los Angeles.

One video showed a Los Angeles Police Department officer dousing a handcuffed suspect in the face with pepper spray as the suspect sat in a patrol car.

That video came to light Monday, just days after the LAPD and the FBI launched investigations into another videotape showing a police officer hitting a suspect in the face several times after a foot chase in Hollywood.

UCLA Assistant Police Chief Jeff Young said Wednesday that he had viewed the video of the campus incident on the Internet and would view any other videos that were shot.

We will gather as many samples as we can find, from different sources, Young said. We'll use it for our own administrative investigation.

Here is the campus police's military necessity justification for repeatedly electrifying an unarmed man already lying on the ground and offering no physical resistance, let alone physical threat, to the armed and uniformed gang of peace officers surrounding him:

The Powell Library is university property, and authorized agents of the university have every right to force out someone who does not use the library according to the policies set by the university. What they have no right to do is to carry out those aims by repeatedly using powerful electric shocks to immobilize a helpless man with pain, over and over again, when he is already lying on the ground, solely in order to keep control of the situation or to ensure students' safety when the students themselves feel far more threatened by the belligerent and violent police. Whether or not they found it necessary to torture Tabatabainejab with electric shocks in order to accomplish those things is quite irrelevant. As Edmund Burke once wrote,

To prove, that these Sort of policed Societies are a Violation offered to Nature, and a Constraint upon the human Mind, it needs only to look upon the sanguinary Measures, and Instruments of Violence which are every where used to support them. There are three things about the video that are just terrible to watch and to hear. The first is the obvious one: Tabatabainejad screaming in pain and writhing on the floor as cops assault him again and again. But the second is just as awful: the crowd of 50 or 60 students, outraged at the police's ongoing assault, and doing nothing about it other than yelling at the cops and indignantly demanding their badge numbers-apparently in the fantastical belief that a The Law is somehow going to protect them from violence at the hands of its own rampaging hired goons. The third are the comments from the bare-fanged sadists who inevitably came along, as they come along in every case like this one, to add remarks like this:

Did you know that if a college student has a bad attitude towards armed strangers giving him orders, that justifies the cops using violence, up to and including hitting him with immobilizing electric shocks, over and over again, while he lies on the ground, in response? Just about every year, right around now, I get to hear the same thing again: a bunch of students, most of them white, threw a party involving blackface costumes and other forms of crude racist caricature. It happened at Auburn-at least twice. It happened at Ole Miss. It happened at Syracuse. It happened at Oklahoma State. It happened at Stetson. It doesn't always happen at a fraternity party, but it often does. Sometimes the kids opt for broad pastiches of gangsta images that they've picked up from MTV. Sometimes they opt for explicit references to the history of slavery and militant white supremacy. Sometimes-as it seems happened in Baltimore-they opt for both. The pattern is established, and the reactions are reliable. While University administrators are busy rushing to make a public example of whoever was caught throwing the party, and anxiously insisting (to anybody who cares to listen) that this is an isolated incident, not representative of the campus culture, etc. etc. etc., it's left to those who know something about what actually goes on on campus (usually Black students or faculty) to point out, yet again, that these things happen in a broader context, that this is nothing new, that things like this happen all the time on campus, and that the only thing special about this case is that the story went public. Then a few months later, everything settles back down, the administration eases or completely reverses its disciplinary actions against the fraternity, and we wait until late next October or early next November, when exactly the same damned thing happens at yet another Halloween party somewhere else.

In case you were wondering, it's still that time of the year, and the brothers of Sigma Chi have continued their tradition of leadership and service-not only at Johns Hopkins, but also at Whitman College in Walla Walla, Washington:

Walking into the Survivor-themed greek party, Sigma Chi juniors Brice Crayne and Bryan Ponti could never have imagined the kind of reaction their costumes would ultimately get. They said later that they just wanted to stand out: and with their faces and bodies painted entirely black with orange markings, they certainly did. It didn't strike them that their body paint would eventually move the entire campus to a standstill.

Senior Natalie Knott was browsing the Internet in the library when she came across photographs of Crayne and Ponti from the party. Feeling a gut reaction, Knott showed the pictures to a few friends who didn't see much controversy.

I had to leave the library because I was really angry but I couldn't figure out why because nobody was seeing what I saw, Knott said. She drew connections to racist archetypes, specifically the blackface minstrel shows popular in the early 1900s. After speaking for hours about the issue with friends in her apartment complex, Knott decided she should bring her concerns to a faculty member.

The next day, Knott consulted with Politics Professor Bruce Magnusson, who told her that she should show the photographs to the dean. After conferencing with student life committee chair Clare Carson for an hour, Knott decided to post her thoughts to the student listserv, at Carson's suggestion.

The response was immediate. Feedback poured in over the listserv from minority students who felt offended, white students who felt attacked and a slew of others whose feelings fell somewhere in the middle.

Meheret Debebe, 19, a Whitman sophomore, said she was more offended by what she read in the listserv than by the picture.

I thought wow, I go to school with a lot of racist people, she said.

Debebe, who is black, said she has felt alienated at her school in the past.

Hovard heard about the e-mail from a friend, and he produced a reply that same night.

I was a little shocked and surprised because I was at that party and the thought of Brice and Bryan dressing up in blackface never crossed my mind. I know that they wore black paint, but I never thought of it as a racial issue, Hovard said.

Neither Crayne nor Ponti responded to the listserv e-mail, but both were personally affected by the incident.

I had to set up a punching bag in my room I was so mad, said Crayne: I felt like someone had passed judgment on me; someone had called me something I definitely am not, and that's a racist.

Ponti felt similarly attacked. The individual who pointed out everything that was wrong with the pictures did not contact either me or my good friend as to our intentions, they simply wrote their e-mail in the heat of the moment and we were caught completely off guard, he said.

God forbid anyone should ever pass judgment on your behavior, or consider what you did apart from the esoteric of what you were feeling, deep down in your heart. Gosh but it must be so hard on them to feel attacked and misrepresented by the majority.

The students, who belong to the Sigma Chi fraternity, say they never meant to insult or offend anyone.

It was never meant to be a statement, Crayne said. We're a couple guys who like to go above and beyond what other people do.

… As for Ponti and Crayne, they have come away with a lesson.

Now that I see I offended people I'll never do it again, Ponti said.

I can totally understand how they were offended and once I thought about it in that way I apologized. I was sorry, Crayne said.

Still, I can't say that I'm particularly encouraged that college juniors think it's a perfectly good excuse, in cases like these, to pass themselves off as too damned ignorant and thoughtless to be expected to know anything in particular about the history of race in America, or minstrel shows, or the use of blackface, or why folks just might not be entirely cool with it.

The faculty's response has been relatively sensible: besides encouraging Knott to bring the FaceBook photos up with her fellow students, they've also cancelled a few classes to put on community events to teach about the history and implications of blackface. The administration, on the other hand, has taken this as a chance to boldly wring their hands about a PR disaster and take serious steps towards slapping the offending white frat boys on the wrist:

The costumes have since spurred heated discussions, seemingly divided the campus and prompted a Town Hall meeting that drew hundreds.

In the most recent response to the blackface incident, all classes were suspended Thursday while the college held a daylong symposium on race and diversity.

In response, college President George Bridges worked with faculty and student leaders to address the tensions and to start the process of educating the campus on racial sensitivities.

Ponti and Crayne were not disciplined, but did meet with Bridges.

I'm glad they got their talking-to and all, but I can't say that this entirely dislodges Amanda Marcotte's question-and-answer: Where are college kids getting this idea that they should have the benefit of having their racism and sexism coddled and protected? Obviously, that's just a rhetorical question, because I know exactly where they're getting that idea, which is from all the authority figures who coddle and protect them.

It's early November; that means it's time for yet another isolated incident at a Halloween party on yet another college campus. This one comes to us thanks to the brothers of Sigma Chi at Johns Hopkins University:

BALTIMORE - Johns Hopkins University suspended a fraternity Monday afternoon following a racially themed Halloween party Saturday night at an off-campus house.

Members of the Black Student Union and supporters rallied on North Charles Street in front of the campus, speaking out against the local Sigma Chi chapter and perceived racial hostility on campus. Hopkins is investigating the party and said the national Sigma Chi fraternity has imposed a 45-day suspension of the chapter's activities and will conduct its own investigation.

The uproar began shortly after the Halloween in the 'Hood party was advertised on the Web site Facebook.com. The invitation encouraged racial-stereotyping costumes, included references to the late attorney Johnnie Cochran and O.J. Simpson, and prefaced descriptions of Baltimore as a ghetto, the hood and the HIV pit with a four-letter epithet.

The invitation was attributed to Justin H. Park, who is listed as a Sigma Chi Class of 2008 member on the fraternity's Web site.

Johns Hopkins said in a written statement that the Greek life coordinator had told the chapter president last week that he found the advertisement racist and offensive, and directed the fraternity to withdraw the advertising immediately, but it reappeared without the coordinator's knowledge, in an altered but still offensive form.

… A small group of black students went to the party and said white students were dressed as pimps, prostitutes - and slaves. Outside the front door of the house in the 200 block of East 33rd Street was a plastic skeleton dressed as a pirate, hanging from a rope noose.

And then as you walked up to the house, you heard fake gunshots - as if there is a gun fight in this neighborhood every night, said freshman Blake Edwards, 18. The noose is extremely offensive and makes a mockery of the minority students that go to school here. Several of the girls I went with left in tears.

The entire city of Baltimore should be offended by this.

Just this last weekend I was driving to work, just south of the University of Michigan campus, looking at the party-goers wandering to campus Halloween parties in their costumes. And I drove through the streets wondering whether I'd be seeing the Klan robes, the nooses, the blacked-up white boys dressed as slaves, or the thug poses and afro wigs and the insufferable grins. And wondering, if I didn't see it, whether it was going on somewhere else, out of my sight, where it would hit the papers in a few days. I was worrying about all these things when I should have been enjoying the simple, silly joy of people dressing up for the night because every fucking year I can fully expect to hear another story about another racist party, just about now. Over and over again.

Thanks a lot, guys. You have officially ruined Halloween.

Yet another isolated incident: blackface in Ohio pee wee football

Say, did you ever wonder where all these white college kids come from who are so wilfully stupid, or so openly malicious, that they think that minstrel-show blackface is a great party gag?

The answer is they come from white suburban families who are so wilfully stupid, or so openly malicious, that they think that minstrel-show blackface is an appropriate way to root for their kids' pee-wee football team and rib the (mostly black) opposing team.

Here's the story from WKYC Cleveland:

HUDSON - A pee-wee football game between Hudson and Shaker Heights turned into a lesson on racism.

Shaker parents say that Hudson fans, took their team spirit too far. They say those fans became offensive, even racist, because they wore black face and afro wigs.

The parents also claim the Hudson fans beat on frying pans on the sidelines.

Some of the kids on the Shaker team even say they used racial slurs.

It was supposed to be about fun building skills and teamwork. To the seven eight and nine year olds on the Shaker team, the game ended up being about our country's racist past.

They were calling us ns - the n word, is what one nine year old said.

They shouldn't say that to other people because they don't know what it means to us, another player said.

The racial slur was enough to bother these kids but it wasn't all they faced on the field. There were Hudson fans dressed in black face.

Alleged racism? Whoa, look out there, some fire-eating demagogue has gone so far as to allege that ordinary white people with Midwestern accents and middle-class incomes might be doing something racist when they put on blackface and shout nigger at grade-school black children. Quick, activate the White Denial!

But many parents of the Hudson players told Channel 3's Mike O'Mara that there was absolutely no intent for any of their fans to be offensive.

Kelly Dine is a parent of a Hudson player.

It was two little boys, not the entire fans, that happened to wear part of the Halloween costume, Dine said. They thought they were supporting their brother on the team.

Oh, O.K. I mean, this doesn't explain away everything. But hey, you've got to admit that if it was part of a Halloween costume, then minstrel-show blackface is totally appropriate. Right?

And besides which, we can hardly expect children to have parents, who might have explained to them that racist caricature might not go over so well with a mostly-black football team or their families.

Clearly there is no racism involved here. Didn't they get rid of that in the sixties, anyway?

O.K., so this isn't working so well. Better try the Insincere White Apology instead:

Meanwhile, in downtown Hudson, residents are deeply upset about the perception of insensitivity. The banners in the business district proclaim a history of excellence.

… Dine said that she feels very badly if the Shaker parents felt like they were offended.

If two little boys had these wigs on and they perceived that somehow it was an insult against them, it wasn't. It was truly to support our 8, 9 and 10 year old boys.

Oh, man, that I'm sorry you're offended apology just never gets old. Here's more from the Cleveland Plain Dealer (via Alas, a blog (2006-10-26)):

[Coach Jeffrey Saffold] said after Sunday's game, he complained to John Elffers, president of the Hudson Hawks Youth Football Association, who sent him a letter apologizing for the fans' actions.

Elffers, however, said the first complaint he heard came Monday when Saffold called him and said parents of Shaker players were offended. Elffers said he doubted supporters meant to be offensive.

Their actions, albeit unwise, foolish and insensitive, were meant to be totally supportive and not intended to insult or offend anyone in any way, Elffers wrote in his letter to Saffold. We regret what occurred and apologize for any righteous indignation these actions may have caused to the coaches, players, parents and family members of the Shaker football organization.

Just out of curiosity, if the blackface and afro wigs weren't intended to insult or offend anyone in any way, what exactly were they intended to do?

O.K., so maybe that one didn't work out so well either. Better fire up the White Dissociation, quick:

Liz Murphy has owned the bookstore in downtown Hudson for 23 years.

I want to tell them that we're not like that, Murphy said. I was horrified.

I'm sure that Liz Murphy doesn't personally feel like that. You might wonder, in light of what just happened, what could entitle her to invoke the royal we, here. But I'll bet the people who are like that don't have anything to do with all the good white folk of Hudson. They probably don't even come from Hudson. I hear they fell into the football game through a wormhole that leads back to their Evil Racist Dimension, where everyone wears a mullet, where everyone speaks in funny accents, and where this sort of things is enjoyed or at least quietly tolerated. Certainly this has nothing to do with the sort of community that the white majority in Hudson, Ohio has built, or the assumptions they share, or the customs they indulge in, or the habits of thought they have fallen into. Nothing to see here, citizen; move along.

The mayor of Hudson, William Currin, said personally I am appalled and saddened by the reported acts. I don't condone nor will I tolerate such actions. I will be investigating this incident and working with all interested parties to try to prevent this sort of thing from ever happening again. Please know that this is an isolated incident and in NO WAY represents the vast majority of the upstanding citizens of Hudson.

Student strike at Gallaudet University

Here is what Oliver Sacks wrote about the legacy of the 1988 Deaf President Now student strike at Gallaudet University, the world’s only liberal-arts university designed for deaf and hard-of-hearing students, and a backbone of Deaf culture in the United States. This is from his beautiful book, Seeing Voices:

All sorts of changes, administrative, educational, social, psychological, are already beginning at Gallaudet. But what is clearest at this point is the much-altered bearing of its students, a bearing that conveys a new, wholly unself-conscious sense of pleasure and vindication, of confidence and dignity. This new sense of themselves represents a decisive break from the past, which could not have been imagined just a few months ago.

But has all been changed? Will there be a lasting transformation of consciousness? Will deaf people at Gallaudet, and the deaf community at large, indeed find the opportunities they seek? Will we, the hearing, allow them these opportunities? Allow them to be themselves, a unique culture in our midst, yet admit them as co-equals, to every sphere of activity? One hopes the events at Gallaudet will be but the beginning.

Unfortunately, the answer from the Gallaudet University administration and Board of Trustees—even those who were direct beneficiaries of the Deaf President Now movement—appears to be No, not yet. Here’s the story from The Washington Post (2006-10-07):

Hundreds of protesters took over the main classroom building at Gallaudet University on Thursday night and refused to leave yesterday, demanding that the board of trustees reopen the search for a president.

With trustees meeting on campus and celebrating outgoing President I. King Jordan, students pitched tents outside the entrances to Hall Memorial and blocked the doors. Inside, trash cans and desks held elevator doors ajar, and the floor was covered with sleeping bags, cans of energy drink and fliers that spread messages to the school for the deaf: THE BOARD OF TRUSTEES WON’T LISTEN TO US! and DO NOT LET ANYONE IN.

When security officers arrived early yesterday, students said, they couldn’t understand what officers were saying — that officers gave orders without sign language and did not seem to understand that the protest was peaceful. Some people were injured when officers shoved their way through and used pepper spray, students said.

A lot of people are scared, Leah Katz-Hernandez wrote on a neon yellow notepad, and some faculty members were in tears as they signed with students.

Communication with security staff is an emotional issue at the university. In 1990, a student died while being restrained by security officers; his hands were cuffed, so he couldn’t use sign language.

The administration has denied that pepper spray was used and said that officers used sign language and that no students were hurt.

… The choice of the school’s next leader has divided campus since the spring, prompting faculty no-confidence votes and protests last semester and continuing opposition by a coalition of faculty, students, staff and alumni. In a scene reminiscent of student takeovers of District universities in past decades, protesters barricaded doors and refused to compromise.

At some schools for the deaf elsewhere in the country, groups pitched tents and made signs supporting the Gallaudet protesters.

The leaders of the National Association of the Deaf issued an open letter saying the campus is in crisis and asking the board to exercise leadership and for the university to immediately cease any confrontational tactics toward campus faculty, students, and staff.

In May, when the board of trustees announced that then-Provost Jane K. Fernandes would be the next president of Gallaudet University, students stood up and walked out of the auditorium, climbed onto the front gates and began to protest.

They said that the search process was unfair, that Fernandes was not strong enough to lead a school often seen as the cultural backbone of the deaf world and that the board had ignored their concerns.

Because longtime President I. King Jordan swept into office after students demanded a deaf president now and started a civil rights movement, the selection of Fernandes had particular weight for the deaf community.

Since May, protesters say, the university has only become more deeply divided.

What is her plan? And, what is she waiting for? She had all summer to bring the community together, but as you can see, [that] didn’t happen, wrote Andrew J. Lange, president of the Gallaudet University Alumni Association, which is setting up an independent Web site because it cannot send e-mail to alumni without university approval.

The second wave of demonstrations began last week when the board of trustees met on campus. Protesters say that the way Fernandes was chosen was unfair and that the board has ignored people on campus for too long.

Last night, hundreds of students agreed to spend one more night in the classroom building. They awaited a response from administrators to a proposal that they would leave the building if the university satisfied 24 demands, including guaranteeing their right to protest in specific areas.

The students also are seeking a public apology from university President I. King Jordan, whom they accuse of making misleading statements about the protesters. The students are not backing down from their original demands to reopen the presidential search process and to guarantee that protesters would not be retaliated against.

In May, faculty members passed a series of no-confidence votes after it was announced that Fernandes, then the provost, would become president.

Trustees have said that their decision is nonnegotiable and that they have chosen the strongest candidate. This summer, Fernandes stepped down as provost to work on her transition to the presidency.

… Jordan, who is stepping down at the end of this year, said yesterday that Fernandes’s leadership since May has been outstanding.

Campus police arrested dozens of student demonstrators at Gallaudet University last night to reopen the famed college for the deaf after a three-day shutdown staged in a long-simmering protest over the appointment of a new president.

The arrests began shortly before 9 p.m., when police began carrying away students from a jeering throng that had been blocking the school’s Sixth Street NE entrance. Students hollered and signed, This is our school! By early this morning, police said, about 80 had been arrested. Witnesses said many students were still awaiting arrest.

Teams of officers, acting on orders from President I. King Jordan and aided by interpreters in orange vests, picked up individual students, who went limp, and carried them to a D.C. police van.

The students were to be taken from the school, at 800 Florida Ave. NE, to a police training facility in Southwest Washington for processing, officials said.

The arrests brought to a head a bitter dispute that began in May between the administration and students angry about the appointment of then-provost Jane K. Fernandes as the university’s next president. She is scheduled to replace Jordan, who is to step down in December.

Protesters expressed dislike for Fernandes, saying she was remote and divisive. They argued that other candidates, especially minorities, had been overlooked. And they called for her to step aside.

She has refused, saying she is the target of student extremists. And earlier yesterday, speaking to the protesters for the first time this week, she said: This has gone on long enough.

About 7 p.m., Jordan announced to demonstrators at the school’s main gate on Florida Avenue that they faced arrest if they did not disperse. I deeply regret being forced to take this action, he said. But the protesters have left me no choice.

Two hours later, after three warnings from campus Police Chief Melodye Batten-Mickens, arrests began at the Sixth Street entrance.

I have no particularly strong opinion on the groups, the individuals, or the actions involved in the student strike and lock-in at Gallaudet. How would I know? I’m not deaf (or Deaf), I have no personal connections with Gallaudet or anyone there, and I haven’t done research beyond reading through news stories, Op-Eds, and weblogs for an hour or two today. But I do have some experience with abusive power-mongering and cronyism from University Trustees and administrators. I also do know enough to know that these issues are particularly sensitive for Deaf students, many of whom are sick and tired of being ignored, patronized, and manhandled by know-it-all suits connected with the established power structure. From what I can see, it looks to me like Fernandes had damn well better step aside in light of the vocal opposition to her from students, faculty, and staff.

This Halloween, the (mostly white) women’s softball team at Stetson University in Florida decided to live it up by dressing as the (mostly Black) women’s basketball team for an off-campus Halloween party. Some of the nice little details that they decided to add to their costume included: gold teeth, corn rows, thug poses for photos. Oh, and also blackface makeup.

We’re told by a student from the campus who knows them that I do not think the girls were trying to be racist; I honestly believe that they do not understand what they did. That’s probably true. It’s also very sad. Fortunately, though, careless ignorance of recent American history and blackface fun-and-games at college Halloween parties aren’t at all pervasive or common among affluent white college students. This is, of course, just an isolated incident; it’s not like there is any kind of festering racism in the American campus culture at all. Nothing to see here, citizen; move along.

Historical note, free of facile sarcasm

I don’t just say this because I know people in the Auburn fraternity system who are not the sloped-brow, amoral, reactionary meatheads that the Greeks’ history on Auburn’s campus might lead you to believe they would have to be—although this is definitely true; I have friends in the fraternity system who neither have nor want any part of that mindset. I also say it because I really regret that the meatheads that were directly involved will probably never understand just what they did wrong. They will understand that they did some dumb things that got them caught. And they may look back and grumble at the P.C. Thought Police Bastards who ruined their college career. But will they ever understand that there really was a very deep cut of wilful cruelty in what they did? They didn’t put on those costumes in order to be malicious racists (although I believe that there was certainly some overt malice involved). They put them on to have a roguish bit of fun, that old irreverant frat boy panache. Meaningless images of MTV gangstas and some documentary on the Klan they saw in school or on the History channel—trivial, ultimately, like the whole flux of images across our consciousness. Anything can be funny, right? If you don’t really go out and attack Black people, the images don’t mean anything, do they?

But words, images, costumes, historical scripts do mean something; they mean a hell of a lot. The images and rituals, the signs of white supremacist brutality in this country have a meaning, a meaning they are rooted to by centuries of blood and chains. But we live in an age in which the detached image and the spectacle is omnipresent, and yet the prevailing laid-back liberal ideology tells us that we have no reason to care, indeed, that if we do care it’s a sign of pretentiousness, humorlessness, a general need to lighten the hell up. And it’s slowly, surely killing our conscience, eating away at the possibility of being moral agents. Which has what to do with frat boys in Klan robes? I really fear that this soul-killing laid-back liberalism, the impetus behind the costumes in the first place, will also cripple the boys at Beta and Delta Sig from ever understanding what they did wrong, the cutting cruelty that they were willing to ignore in order to have a laugh. Just as much as their hate party outrages me against them, what it means also saddens me for them.

GT 2001-11-14: One down, one to go…

The worst part about it all are the smiles. The goofy, clueless, happy-go-lucky grins of white college students who don’t understand a goddamned thing about what they’re doing, and just don’t care.

This is a picture of a Jolly Nigger Bank. During the 1880s these were a remarkably popular mechanical bank for children; place a coin on the black man’s hand and he pops it into his mouth as his bug-eyes roll back into his head. the Jolly Nigger Bank was just one of hundreds of popular children’s toys, during the late 19th and early 20th centuries, that used grotesque caricatures of Black people, based on the images and conventions of blackface minstrel shows. It’s hard to believe, today, how pervasive these images were: they were everywhere, not just in children’s toys but also staples of the most popular forms of music and theater, film, cartoons, even advertising brands for everything from pancake mix to washing powder. Blackface caricatures surged in popularity in the decades after Reconstruction, and continued well into the 1940s before the rise of the Civil Rights movement in the 1950s and 1960s did it in. Blackface imagery was a pervasive feature of American pop culture for over a century, a feature intimately connected with casual racism, militant white supremacy, lynch law, race riots, and Jim Crow (you may recall that the system of segregation was itself named after America’s first known minstrel show stock character.

Now, there are two different ways that horrible things can end in the wake of coordinated cultural pressure. The privileged can remember them, and take responsibility for them, as hateful reminders of a shameful past. Or the privileged can do their best to pretend that they never existed, avoid mentioning them for fear of giving offense, drop them down the memory hole in the name of propriety, and drive them into the cultural underground rather than addressing them in the daylight.

Affluent whites in America — that same college-educated professional class that we daily hear praising itself and berating the redneck, reactionary white working class — decided to do the latter, not the former, with blackface when Black people made it clear that they weren’t going to stand for it anymore. Down the memory hole they sent it, and they taught that response — by not teaching that history — to their kids. You are seeing the affects of that decision on white college kids’ consciousness with every passing school year.

Which freedom?

I’ve already mentioned here why I think that (Ward Churchill|Hans-Hermann Hoppe) shouldn’t be fired, even though he’s demonstrably an ass. In the course of doing so, I mentioned off to the side a direction I didn’t think the argument should go—but things seem to be getting steadily worse, so it may be wortwhile to touch on it a bit more.

A lot of people seem to think that the reason to join the fight over (Churchill’s|Hoppe’s) remarks, and the threatened repercussions from his University employers, is to defend his First Amendment rights, or to defend free speech from censorship by (Evil Right-Wing Jingoistic Goons|Evil Left-Wing Thought-Police).

No it’s not.

Let’s start with censorship. In the Roman Republic, the censor was a government official who, among other duties, was charged with safeguarding public morals (and had power to, for example, punish unmarried couples living together or land owners who did not keep up their property). Censorship has expanded and shifted in its meanings since antiquity, but the one thing that all censors have had in common is: they are, one and all, government officials who use force backed by law to suppress free expression. Censorship is a government act, and like all government acts, it is ultimately backed by violent enforcement. (Don’t believe me? Try publishing a censored newspaper in, say, Singapore, and see what happens to you.)

Censorship is, properly speaking, government suppression of free speech. No more, no less. Of course, you might talk loosely about censorious people or organizations without referring to any kind of government enforcement, but this is only a loose analogical usage. More to the point, it’s not the way you’re using the term when you say that the First Amendment bans censorship. All the First Amendment prohibits is invasive acts of government:

Congress shall make no law … abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.

But that’s not what happening to Ward Churchill or Hoppe. There are lone nutcases calling for all sorts of retribution, of course, but nobody politically in a position to make a credible threat is claiming that Churchill or Hoppe should be fined by the government or thrown in prison or burned at the stake, and given that all of these things have been done to real people in the past, it’s a bit insulting to lump the late unpleasantness together with these victims of honest-to-God censorship. The worst that’s been suggested for either is losing his tenure and his job; mostly what’s been floated are administrative reprimands and punitive cuts in pay or position. It’s true that—in spite of the fact that Churchill’s and Hoppe’s remarks were complete claptrap—they shouldn’t have to face that. It would be foolish. It would be petty. It would be narrow-minded. But it wouldn’t be censorship.

So what’s wrong with it, then? Well, the problem in this whole debate is that two related, but importantly distinct issues:

  1. Freedom of speech, in the sense of political freedom from censorship

  2. Academic freedom, the ability to participate in scholarly discussion without repercussions from academic employers, even if your views are unpopular or controversial

People on both the Right and the Left run (1) and (2) together all the time, but the fact is that they’re completely different issues, and if we want to fight for them both (which we should) then we need to recognize that they’re different and why. Free speech in the sense of (1) means freedom from government coercion; it’s a good thing to have because if you don’t have it, what that means is at some point or another some goon is going to pick up a gun or a billyclub and use force or threats in order to keep you saying only what the government thinks you should say—which is tyanny, even if what you say is mistaken, ill-reasoned, foolhardy, or even hateful. That’s damned important to keep in mind and to act on; but there’s no call to act on it in this case, because Churchill and Hoppe aren’t being threatened with force by any government officer.

Academic freedom in the sense of (2), on the other hand, has nothing at all to do with freedom from coercion. If we intend to defend it in any kind of intelligent way, just pointing to the Constitutional and moral arguments for freedom of speech in the sense of (1) are going to be completely misplaced. Freedom of speech doesn’t mean being obligated to provide anyone with a microphone, and getting the government to force other people, against their will, to print or air views that they find repellant or keep employing the person who airs those views, is no less tyrannical than getting the government to force people not to print views or employ teachers that the government finds unsuitable.

That doesn’t mean that firing Churchill or Hoppe for his controversial (and stupid) views would be a good idea; it just means that it wouldn’t be a violation of his rights. Saying that academic freedom is different from free speech doesn’t mean that it isn’t very valuable. It is. But it’s valuable for different reasons. Specifically, it’s valuable because academic freedom in Universities is an essential part of a third value:

(3) Open debate, the encouragement of vigorous, wide-ranging, well-reasoned public debate

It’s hard to have open debate if even those who are paid to inquire and debate for a living are always afraid that they’ll lose their job or face retaliation from their employers for holding controversial views. Enforcing a party line is a damn good way to get bad research and timid debate. If you rule views you find odious out of bounds for discsussion before you even hear the arguments for them, then you’re not going to be able to make any serious effort at getting to the truth.

That’s why Churchill’s and Hoppe’s cases are important. Not because you need to defend to the death their right to say what you disagree with—the issue isn’t their right to say anything (which isn’t at issue) but rather their opportunity to make arguments for it in a civil forum without fear of reprisal from their Universities. Open debate is important to have if you want to make any serious progress for civilization or human freedom, and you can’t have that if you decide that, regardless of the quality of argument, you’re just not going to listen to, or acknowledge, certain people because you disagree with their conclusions.

But notice the difference from free speech here: the issue isn’t your right to say something, but rather your opportunity to get a hearing for your argument for what you say. It’s a very good thing for Universities (and, mutatis mutandis, other outlets for public debate) to consult, and publish, and vigorously discuss many substantively different views on the important issues of our day—but only in the context of reasonable standards of intellectual honesty, scholarly rigor, clarity, etc. Free speech doesn’t have any constraints of that sort—you have a right to say things that are glib, superficial, wildly dishonest, unargued, or belligerently stupid. The moral and Constitutional arguments for free speech are all for unlimited free speech; leaning on them when what you’re really trying to argue for is academic freedom ends up as a call to artificially pump up the diversity of conclusions, without regard to the quality of the argument, in the name of defending the right of opposing views to get a hearing. And that undermines the very goals of rational, informed discourse that academic freedom and open debate are meant to preserve.

The late unpleasantness is only the most dramatic illustration of a troubling long-term trend in the U.S.: major public opinion outlets (in the newsmedia and elsewhere), and increasingly even Universities, seem to have no qualms about neglecting, ignoring, or even blacklisting far too many people for having controversial opinions, without considering their arguments. But that’s not censorship; it’s foolishness, and dishonesty on the part of those who try to shut down discussion.

This isn’t just hypothetical grousing about bad arguments; the confusion has practical consequences that we see every day. Churchill’s defenders on the radical Left and Hoppe’s radical libertarian defenders aren’t the only people who have used these kind of arguments; it’s now a favorite of raving lunatics, Holocaust-denying weasels, and jingoistic politicians who have repeatedly used phony charges of censorship in order to try to Mau Mau timid University bureaucrats into giving them a stage for their views whether or not those views are presented within any reasonable standards of intellectual honesty or scholarly rigor. Hacks like that ought to be ignored, denied a stage, and denied jobs at serious research Universities; there’s no censorship involved in that. Churchill’s and Hoppe’s arguments were idiotic, but unlike (say) the fabrications of a David Irving or the mad-dog rampage of a David Horowitz, there’s no reason to say that they’re outside the standards of academic standards for argument or for teaching. That’s why it’s worth it to stand up for their academic freedom, not because they have some kind of right to carry on however they please without being called to account.

When you equate the virtue of academic freedom with the right of free speech, you end up with calls for enforcement in law; the logical end-point of the the David Horowitz-David Irving gambit is phony free speech legislation like Title VI or Horowitz’s own Academic Bill of Rights—bills which try to use government force to tilt academic discourse in the name of increasing the numerical diversity of conclusions, out of misplaced free speech concerns. That’s a direct assault on the idea of the University, and completely undermines all the reasons we have to say that open debate is worth having in the first place.

The (Churchill|Hoppe) fracas is important, but not because it’s a threat to free speech or the First Amendment. It just ain’t, and if you keep pushing that line you’ll find yourself muddling the issue and travelling in some really unpleasant company. (And jeeze, Churchill and Hoppe are unpleasant enough on their own!)
